Terms of service

This is a working draft. Final wording will be reviewed before launch. By using Toby you agree to these terms.

The service

Toby is a customer-management app for tradespeople, provided by Seagull Tech Solutions Ltd. We provide it on a subscription basis and aim to keep it available, but we don’t guarantee uninterrupted service.

Your account

You’re responsible for keeping your login secure and for the content you put into Toby. Don’t use the service for anything unlawful.

Subscriptions & billing

Plans are billed monthly after a 14-day free trial. You can cancel at any time; cancellation stops future charges. See the refund policy for details.

If you ever have a billing concern, contact us first and we’ll put it right. If instead you initiate a chargeback or otherwise reverse a payment, you are in breach of these terms and we may suspend or close your account. Except where the law or our refund policy provides otherwise, fees already paid are non-refundable.

Your content

You own your data. You grant us the limited licence needed to process it so we can run the service for you. You can export or delete it at any time.

Liability

Toby is a tool to help you stay on top of your work; it doesn’t replace your own judgement. We provide the service with reasonable care and skill, but we don’t guarantee it will be uninterrupted or error-free.

To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of profit, revenue or data arising from your use of Toby, and our total liability to you in any 12-month period is limited to the amount you paid us in that period. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

Eligibility

Toby is currently offered only to residents of the United Kingdom. By creating an account you confirm that you are resident in the UK. We may decline, suspend or close accounts that do not meet this requirement.

Governing law

These terms, and any dispute or claim arising out of or in connection with them or your use of Toby (including non-contractual disputes or claims), are governed by the laws of England and Wales. You and we agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
